Terms of Use
These Terms of Use govern your access to and use of the Finx iOS application, websites, backend account features, transaction syncing and budget automation, and related services (collectively, the "Services") operated by Momo Apps LLC, a California limited liability company ("Finx," "we," "us," or "our"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
These Terms work together with the Privacy Policy, which explains how Finx collects, uses, shares, and deletes data.
For the warranty, liability, indemnity, and related risk-allocation sections, "Finx Parties" means Momo Apps LLC and its owners, managers, officers, employees, contractors, affiliates, licensors, and service providers.
App license and Apple EULA
The license for the Finx iOS app is governed by Apple's Licensed Application End User License Agreement (the "Standard EULA"): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These Terms apply to the Services in addition to that app license. To the extent Apple requires the Standard EULA to govern the app license, the Standard EULA controls that app-license relationship.
Eligibility and accounts
You must be at least 18 years old to use the Services. By using the Services, you represent that you are 18 or older, that you can form a binding agreement with us, and that you may legally use the Services where you live. Finx is a financial budgeting tool that can link to bank accounts, and it is not intended for minors.
Some features require an account, including Sign in with Apple and subscription-linked access. You are responsible for keeping your account access secure and for activity that occurs through your account.
The Services are offered only to individuals residing in the United States for connection to supported United States financial accounts. You may not use the Services where doing so would violate applicable law.
What Finx is and is not
Finx is a budgeting and app-locking tool. It helps you create spending budgets and, when configured, may restrict selected apps or categories after transaction data indicates a budget is over limit.
Finx is not a bank, broker, accountant, tax advisor, investment advisor, credit counselor, debt-management service, fiduciary, consumer reporting agency, credit service, or financial planner. Information in the Services is for budgeting and self-management only. You are responsible for your spending, banking, tax, investment, and financial decisions.
Do not use Finx, budget state, transaction categories, app-locking state, or any output from the Services to make credit, lending, employment, housing, insurance, eligibility, or similar decisions about any person.
Financial data and Plaid
Finx Plus may let you link a financial account through Plaid so Finx can sync account and transaction information. Plaid, your bank, card network, merchant processors, and other financial systems can delay, revise, remove, or recategorize transactions. Finx may therefore lag actual spending or show incomplete information.
Your use of Plaid is also subject to Plaid's applicable end-user terms and privacy disclosures, including Plaid's End User Services Agreement (US) and End User Privacy Policy.
You are responsible for reviewing synced transactions and budget state. Finx does not guarantee that any transaction, balance, merchant name, category, budget calculation, lock, or unlock will be accurate, complete, or available at any specific time.
You may connect only a financial account that you own or that you are legally authorized to access and use with Finx. You authorize Finx and its service providers, including Plaid, to retrieve, receive, process, and store permitted account and transaction information for the purposes described in the Privacy Policy. You must not use Finx to access another person's financial information without their express authorization.
Plaid separately collects, uses, retains, and shares information under Plaid's End User Privacy Policy, and Plaid's processing is not governed solely by Finx's instructions. Finx does not receive or store the credentials you enter directly with Plaid or your financial institution.
Screen Time and app-locking limitations
Finx's app-locking features depend on Apple's Screen Time and Family Controls frameworks, device settings, operating system behavior, and the selections you configure. App and category selections can be imprecise, and locks may fail, lag, release late, or behave differently after iOS updates or permission changes.
Finx is a voluntary personal budgeting and self-management tool. It is not a safety, security, parental-control, medical, emergency, authentication, or access-control service. You may use app-locking only on a device you own or are legally authorized to control and only for your own use. Do not select applications or categories needed for emergency communications, navigation, health, authentication, financial access, employment, legal obligations, or other essential functions. You are responsible for maintaining and testing an independent means of access and the emergency override.
App restrictions may be delayed, fail to activate, remain active longer than expected, or be removed because of transaction delays, device settings, operating-system behavior, permissions, network conditions, or third-party service failures. Do not rely on Finx to block access to critical services, emergency tools, health apps, banking apps, password managers, phone, messages, maps, or other apps you may need for safety or essential tasks.
Subscriptions and billing
Finx may offer paid subscriptions or premium features, including Finx Plus. Purchases made in the iOS app are billed by Apple through your App Store account, not directly by Finx. Apple handles payment methods, renewals, cancellation flows, and refunds under Apple's own terms and policies.
Auto-renewable subscriptions renew until canceled through your Apple account subscription settings. Deleting your Finx account does not cancel App Store billing. If Apple reports that a subscription expired, was refunded, was revoked, or failed to renew, we may suspend or remove the related premium access.
Features, prices, plan structure, and trial availability may change over time. Except where required by law, refunds for App Store purchases must be requested through Apple.
Third-party services
The Services depend on third-party services that we do not own or control, including Apple services, Sign in with Apple, App Store billing, Screen Time / Family Controls, Supabase, and Plaid. Your use of those services may also be subject to their own terms and privacy policies. Third-party services are operated by independent entities and may be unavailable, delayed, inaccurate, modified, or discontinued without Finx's control. Finx is not responsible for the acts or omissions of third parties except to the extent responsibility cannot lawfully be excluded, including obligations that apply to Finx's selection and management of its service providers and its protection of personal information.
Acceptable use
You agree not to:
- use the Services in violation of any law or regulation;
- attempt to access accounts, systems, data, or features without authorization;
- interfere with or disrupt the Services, security controls, rate limits, billing checks, or backend operations;
- submit false, misleading, fraudulent, abusive, or harmful information;
- reverse engineer, scrape, copy, or exploit the Services except as allowed by applicable law; or
- use automation, multiple accounts, proxies, or similar methods to evade limits, restrictions, or anti-abuse controls.
Usage controls
We may apply technical, product, or account-level controls, including rate limits, subscription checks, Plaid linking limits, sync limits, temporary restrictions, fraud controls, and security controls. We may change these controls to protect the Services, users, providers, or our systems.
Intellectual property
The Services, including software, designs, branding, text, interfaces, and related content, are owned by Momo Apps LLC or its licensors and are protected by intellectual property laws. These Terms do not transfer ownership rights to you. Subject to these Terms and the Apple Standard EULA, we grant you a limited, revocable, non-transferable, non-exclusive right to use the Services for personal, non-commercial use.
Service availability and changes
We may add, remove, suspend, or change features at any time, including budget rules, Screen Time integrations, Plaid support, subscription benefits, supported devices, and backend availability. We do not guarantee that any feature will always be available, error-free, or continue in its current form.
Suspension and termination
We may suspend, restrict, or terminate access to some or all of the Services if we reasonably believe you violated these Terms, created risk for users or the Services, engaged in fraudulent, abusive, or unlawful conduct, or if required by law. You may stop using the Services at any time. Account deletion does not cancel App Store billing and does not remove local device data, Apple records, Plaid records, or limited records retained as described in the Privacy Policy.
Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or uninterrupted availability. The Finx Parties do not warrant that the Services will be secure, error-free, available at any particular time, or that any data loss, defect, interruption, lock failure, sync delay, or transaction error will be corrected.
Limitation of liability
To the maximum extent permitted by law, the Finx Parties will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or use, arising out of or related to the Services or these Terms. To the maximum extent permitted by law, the aggregate liability of the Finx Parties arising out of or relating to the Services or these Terms, under all legal theories and for all claims in the aggregate, will not exceed the greater of: (a) the amount you paid for the Services in the 12 months immediately preceding the event giving rise to liability; or (b) $100. These limitations apply even if a remedy fails of its essential purpose and even if we were advised that damages were possible.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability arising from Finx's fraud, willful misconduct, or violation of applicable law. Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
Indemnity
You agree to defend, indemnify, and hold harmless the Finx Parties from and against claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your misuse of the Services, your unlawful conduct, your unauthorized access to or use of accounts, systems, data, devices, or financial information, your material breach of these Terms, or your violation or alleged violation of third-party intellectual-property, privacy, or other rights.
We will provide reasonably prompt notice of an indemnified claim. We may control the defense and settlement of the claim, provided that we may not enter a settlement that admits wrongdoing by you, imposes non-monetary obligations on you, or requires payment from you without your consent.
Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Except where applicable law requires otherwise, any dispute arising out of or relating to these Terms or the Services must be brought in the state courts located in San Mateo County, California, or, if federal jurisdiction exists, the federal courts in the Northern District of California, and you consent to those courts' personal jurisdiction and venue.
These Terms do not include an arbitration agreement or class-action waiver. Any future arbitration or class-action waiver provision would require updated Terms and renewed acceptance where required by law.
General
If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full effect. The disclaimers, limitation of liability, indemnity, intellectual property, and governing law sections, and any other provisions that by their nature should survive, will survive termination of your use of the Services. Our failure to enforce any provision is not a waiver of our right to enforce it later. You may not assign or transfer these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and the Apple Standard EULA, are the entire agreement between you and Finx regarding the Services and supersede any prior agreements on that subject.
Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will provide notice through the Services or by other reasonable means. Where a change materially affects dispute resolution, liability, payment obligations, data use, or your rights, we will ask you to accept the revised Terms before the change applies to you. For other changes, updated Terms become effective when posted unless we say otherwise, and by continuing to use the Services after they take effect you agree to the revised Terms.
Notice to California users
Under California Civil Code Section 1789.3, California users of the Services are entitled to the following consumer rights notice: the Services are provided by Momo Apps LLC.
